The Federal Court of Appeal sitting in Benin City, has dismissed the appeal brought the Action Congress candidate, Peter Okocha, against the election of the People’s Democratic Party candidate and Delta State governor, Emmanuel Udughan in the 2007 election.
In a one and half hour judgement, the The five judges; Justice Dongban-Mensan, Justice Hussein Muhktar, Justice Olukayode Ariwoola, Justice Oyebisi Omoleye, and Justice Chima Nweze in a unanimous judgement upheld the lower election tribunals judgement upholding Uduaghan’s election and dismissed Okocha’s challenge against his “unlawful exclusion” from the Delta State gubernatorial election in 2007.
