Abuja High Court restrains NBA from holding branch bye- elections

Abuja High Court restrains Nigerian Bar Association from holding branch bye- elections 30th June 2017 for the position of Chairman and Secretary. Justice U. P. Kekemeke sitting in Apo on 29th June 2017 in Suit No: HC/CV/277/16 between Ezenwa Anumnu vs. Incorporated Trustees of Nigerian Bar Association granted the application of the Plaintiff. The Plaintiff’s legal team led by Tolu Babaleye Esq prayed the court for an order of Interlocutory Injunction restraining the Defendant from conducting any election on 30-6.

The application was opposed by the Defendant’s Legal team led by Mas’ud Alabelewe. The court in granting the first two prayers of the Plaintiff warned the parties not to disobey the express orders of the court and expressly gave an order of Interlocutory Injunction restraining the Defendants/Respondents either by themselves, agents, officials, officers, privies and/or the purported caretaker committee comprising of Mr. Caleb Dajan, Mustapha Abubakar and A.Y Musa or any other committee by whatever name so called and constituted pursuant to the resolution of the National Executive Committee of the Nigerian Bar Association made on March 2, 2017 at Aba from putting into effect the resolutions made at the National Executive Committee meeting of the Nigerian Bar Association made on March 2, 2017 at Aba, Abia State. The court further issued an Order of interlocutory injunction restraining the Defendants/Respondents either by themselves, agents, officials, officers, privies and/or the caretaker committee comprising of Mr. Caleb Dajan, Mustapha Abubakar and A.Y Musa or any other committee by whatever name so called and constituted pursuant to the resolution of the National Executive Committee of the Nigerian Bar Association purportedly made on March 2, 2017 at Aba from conducting any election whatsoever for the offices of Chairman and Secretary of Nigerian Bar Association, Abuja branch, pending the determination of the substantive suit.

The case was adjourned to September 26, 2017 for hearing of The substantive suit. Both Counsel Tolu Babaleye ESQ and Mas’ud Alabelewe after the ruling thanked the court for its erudite ruling and Counsel to the Defendant undertook to communicate the same to his Client.
