Anambra 2021: Court declares Ugochukwu Uba PDP candidate, nullifies Ozigbo
Ozigbo kicks against "black market judgment"
Honourable Justice A.O. Nwabunike of the Anambra State High Court sitting at Awka has, on Monday, declared Senator Ugochukwu Uba as the authentic candidate of the People’s Democratic Party (PDP) in the governorship election coming up on November 16, 2021.
Justice Nwabunike gave the final judgment in suit no: A/230/2021 between Senator Dr Ugochukwu Uba vs Independent National Electoral Commission with the Peoples Democratic Party and Valentine Ozigbo as respondents.
The judge dismissed all the preliminary objections filed by Valentine Ozigbo and held that there was only one proper Congress held in the State.
He also upheld the primary election won by Ugochukwu Uba and declared null and void any other result purportedly won by Valentine Ozigbo.
He relied on Section 25 of the PDP Constitution, Section 87 of the Electoral Act and extant judgment of the High Court of the Federal Capital Territory and directive of INEC that PDP should use the list of authentic delegates of the party to conduct the primary election as basis for the judgement.
Justice Nwabunike frowned at the 62 votes out of 218 random names used to declare Ozigbo the winner of the primary election after same party used the court approved list of candidates to conduct the election that produced Ugochukwu Uba as candidate.
The judgment, if sustained, clears the way for INEC to publish candidate for the Peoples Democratic Party in the upcoming governorship election.
Reports reaching KAFTANPOST is that Valentine Ozigbo camp is dejected and murmuring along the line of filing an appeal. However, many elders of the beleaguered erstwhile ruling party are urging all camps to rally round Ugochukwu Uba and save the party from avoidable appellate litigation that would not brighten the fortunes of the party in a crowded and keenly contested governorship election in the State.
Relatedly, in an earlier message, the Valentine Ozigbo camp has alerted ElombahNews of a “black market judgment” that will be delivered Monday morning by Justice Nwabunike of High Court No. 5, Awka.
The message, signed by one Francis Ogbonna, said well ahead of the judgement that the judge will grant a “black market Court injunction to prevent INEC from… recognizing Valentine Ozigbo as the PDP Governorship candidate”.
He stated: “We have it on good authority that the Plaintiff in Suit No. A/230/2021 between Senator Ugochukwu Uba V. INEC and 2 others, which is currently pending before Justice A.O Nwabunike at High Court Number 5 , Awka, Anambra State has concluded every arrangement this morning of 19th July, 2021 to secure a bizarre black market Court injunction to prevent INEC from doing its constitutional duty of recognizing Mr Valentine Ozigbo as the PDP Governorship candidate for the November 6th, 2021 Governorship election in Anambra State.
“The Uba brothers, one of them being the plaintiff, in the said suit have now delivered the balance of the “judgment fee” as agreed between himself and Justice A.O Nwabunike.
“What is most disheartening is the fact that Justice A.O Nwabunike of High court No. 5, Awka, in his bid to please his paymasters, has jettisoned all known ethics of legal procedure as it relates to fair hearing.
“Justice A.O Nwabunike conducted most of his proceedings without giving hearing notices to Mr. Valentine Ozigbo and the PDP both of whom are defendants in the said suit.
“The court room proceedings that gave rise to the black market injunction/judgment that would be delivered this morning by Justice A.O Nwabunike was hurriedly conducted in the night between the hours of 6pm and 9pm on Friday, the 16th day of July, 2021 with the use of phone torchlight.
“The hired thugs of the plaintiff who provided security for the judge throughout the duration of time the night proceedings were conducted.
“The above facts were confirmed and verified by the court clerks in High Court No. 5, Awka, all of whom were disgruntled by the fact that their boss, Justice A.O Nwabunike compelled them to work in the night of 16th July, 2021 without giving them any share in the money paid for the black market court injunction.
“We will keep you posted on these development,” he added.
Meanwhile, another judge in the same court premises has, on Monday, ordered INEC to publish the name of Valentine Ozigbo as PDP candidate for the November 6 Anambra State governorship election.
