Appeal Court nullifies Senator Ifeanyi Ubah’s sack [Update]
The Court of Appeal in Abuja has nullified the April 11, 2019 judgment of the High Court of the Federal Capital Territory (FCT) sitting in Kuwa which sacked Dr. Patrick Ifeanyi Ubah as Senator representing Anambra South senatorial district.
The court also struck out an appeal filed by Chief Chris Uba as lacking in merit.
In the judgement of a three-man panel of the court, led by Justice Stephen Adah, the court held that Obinna Uzoh and his lawyers, led by Anali Anacletus, committed judicial fraud.
The appellate court, therefore, ordered Obinna Uzoh and Anali to pay N250,000 each to Senator Ifeanyi Ubah for deceiving the court.
In the unanimous judgement delivered by Justice Bello Kawu, the court stated that the FCT High Court judgement was a nullity on the grounds that the originating process was incompetent having not been signed by a lawyer as required.
Justice Kawu stressed that the judgment was given without jurisdiction, and that Ubah was denied fair hearing by the FCT Court.
Justice Adah held that since the cause of action arose in Anambra State, the FCT High Court was without the requisite territorial jurisdiction to have entertained the case.
