Imo By-Election: Ibezim loses appeal, won’t get Certificate of Return
The Court of Appeal sitting in Abuja has dismissed the petition filed by Mr. Chukwuma Frank Ibezim and upheld his disqualification as the All Progressives Congress (APC) candidate in the last Imo North Senatorial District by-election held in Imo State.
Mr. Ibezim lost his appeal over charges of certificate forgery and perjury in the appeal court, hence, cannot be sworn in or issued with Certificate of Return.
A three-man panel of the appellate court dismissed the appeal as lacking in merit in a unanimous judgment on Saturday.
The judges upheld the December 4, 2020, judgment by Justice Inyang Ekwo of the Federal High Court, Abuja, in a suit filed by Asomugha Tony Eleneke.
Justice Ekwo indicted Ibezim of making a false claim about his age and educational credentials and disqualified him.
The defendant made the false claims in the documents he submitted to the Independent National Electoral Commission (INEC), which is tantamount to perjury.
Not satisfied with the decision of the trial court, Ibezim headed to the Court of Appeal.
While reading the judgment on Saturday on behalf of the panel, Justice Stephen Adah said the finding of the trial Federal High Court was unassailable.
He dismissed the appeal by Ibezim noting that the judgment does not warrant any interference by the appeal court.
