….. Declares Their Appointment Illegal
The attention of the Akwa Ibom State Government has been drawn to the recent judgement by Justice Ezekiel Enang of the Abak Judicial Division where he gave a ruling declaring the reconstitution of the 31 Local Government Councils by His Excellency, Mr. Udom Emanuel, Governor, Akwa Ibom State illegal following a suit filed by one Nsikak Akai.
We have followed the attendant welter of misinformation, mischief and abhorrent lies fed by some unscrupulous elements whose atavistic preoccupation remains the merchandising of lies and misinformation to fit their narrow political narrative.
For the interest of the public who may have been misled, here are the facts: The constitution of the Transition Council by His Excellency, Governor Udom Emmanuel was a lawful exercise that was properly done in accordance with the extant laws made by the Akwa Ibom State House of Assembly pursuant to the powers vested in Section 7 (1) of the 1999 Constitution as amended.
An exercise lawfully executed by the Governor pursuant to extant laws of the land cannot therefore, be considered unconstitutional. The constitution of the 31 Local Government Councils by His Excellency, Governor Udom Emmanuel thus remains lawful and the councils have not been dissolved, contrary to the rumours being peddled. Government has however, appealed the ruling and the necessary stay of execution filed.
Members of the public are hereby advised to discountenance and dismiss the lies about the dissolution of the councils by naysayers and instead be prepared to elect their chairmen and councillors during the Local Government elections which has already been scheduled for November 11, 2017,
