As Senator Orji Uzor Kalu Heads Back To Court

In line with the analysis of the Supreme court judgement of May 8, 2020 as it affects Senator Dr Orji Uzor Kalu which was published some days ago, the former governor of Abia state has headed back to the Federal High Court, Lagos.
In our analysis of the Supreme Court judgement, we gave details of why Orji remains in prison despite the celebrated judgement of Supreme Court of May 8, 2020.
We equally concluded that Orji had two options, either to amend his grounds of appeal at the Appeal court or head back to a high court.
There he will seek an order of the court for enforcement of the Supreme Court judgement which nullified the judgement of Justice Mohammed Idris against his co-accused, Mr Ude Udeogu.
From a reliable source, Senator Orji is already at the Federal High Court, Lagos with about 6 Senior Advocates of Nigeria, SAN led by Prince Lateef Fagbemi.
Kalu is at the Federal High Court, Lagos to argued that no legal basis exists for his continued incarceration.
That is because the Supreme Court on May 8, 2020 stated that Justice Idris who was elevated to the Appeal court on June 20, 2018, lacked jurisdiction to continue to sit and conclude the trial of his co-accused person, Mr Ude Udeogu.
The learned senior advocates are to also draw the attention of the court on the judgement which voided section 396 subsection 7 of the Administration of Criminal Justice Act 2015 which Justice Idris relied upon to continue and conclude the matter.
