Upholds Oyetola's Victory Osun APC hails, says ‘God heard our prayers’
The Supreme Court has dismissed the appeal by the candidate of the Peoples Democratic Party (PDP) in the Osun State governorship election, Senator Ademola Adeleke.
The apex court also upheld the victory of Adegboyega Oyetola of the All Progressives Congress (APC) as the Governor of Osun State.
Relying on technicality, Supreme court declared that Justice Obiora of the High court not sitting renders his judgment a nullity.
In the lead judgement by Justice Bode Rhodes-Vivour, the apex court declared that the absence of the judge who read he majority decision of the court invalidates his stand.
A judge reportedly forgot to sign attendance register when the case was tried at the Tribunal and for that reason a major case was lost by the people of Osun.
The Supreme Court verdict was supported by a majority decision of five-to-two, read by Justice Rodes-Vivour.
Rodes-Vivour held that the failure of a member of the election tribunal, Justice Peter Obiora to sit on February 6, 2019, rendered the entire proceedings and the judgment given by the tribunal a nullity.
Reacting to the judgement, Osun State chapter of APC, on Friday, said the “The Progressive God that Osun people serve heard their prayers and granted their request.”
A statement signed by Barr. Kunle Oyatomi, the spokesperson for the party, said “God has used the highest legal authority of the land to proclaim the truth that Oyetola lawfully won. And that is historic.
“Our fears for the calamity that might have befallen the state of Osun, if the PDP had been declared winner, have now been assuaged.”
