Zamfara: APDA Takes Governor Matawalle to The Tribunal
After the withdrawal of nearly all petitions before the Tribunal, a new suit has been tendered before the Zamfara State Election Petition Tribunal sitting in Abuja.
Muhammed Sani Takori of the Advance People’s Democratic Alliance (APDA), has filed a petition against Governor Bello Muhammed Matawalle, the People’s Democratic Party (PDP) and the Independent National Electoral Commission (INEC).
Among the issues raised in the petition is the qualification of the Governor. He argued through his counsel that Governor Matawalle is not qualified to contest the last election because, according to him “he was not duly sponsored by his political party.” Also the petitioner submitted that the election was marred by violence and irregularities.
In his reply on point of law, the counsel to the first Respondent argued that the issue of qualification is a domestic matter.
“Whether a person is validly sponsored by a party is an issue within the domestic territory of the political party. The petitioner is an outsider of the political party and therefore cannot challenge the validity of the candidate.”
He argued further that there is no ground under section 138 of the Electoral Act that gives any enablement to the petitioner to bring this petition before the Tribunal.
The Tribunal chaired by Justice Binta Fatima Zubairu adopted the written addresses of all parties and adjourned ruling to judgement stage. The petition was equally adjourned to the 29th July, for issuance of pre-hearing report.
